1. Scope of Services

Growing Up Media provides modern, paperless school portraiture services to early learning centers, preschools, and private schools. Our services include on-site picture day execution, online proofing via secure client galleries, and direct-to-home order fulfillment.

2. School Administration Obligations & On-Site Safety

To maintain a secure, seamless picture day environment:

  • Escort Policy: For child safety and operational protocol, school administration or designated staff members must accompany Growing Up Media personnel at all times while on school premises.

  • Student Rosters: School administrators agree to provide accurate, minimal student roster details required to generate secure, individual access codes for parents.

3. Photo Proofing, Portal Access, & Ordering

  • Private Galleries: Online image viewing and proofing are hosted through our secure portal partner, GotPhoto Inc.. Individual student galleries are password-protected and accessible only via assigned access codes provided to authorized parents or guardians.

  • Payment Processing: All digital and print orders are processed securely through PCI-compliant third-party payment gateways. Growing Up Media does not retain or store credit card details.

  • Order Accuracy: Parents and guardians are responsible for reviewing digital proofs for image quality and verifying shipping address details before submitting an order.

4. Intellectual Property & Copyright

  • Copyright Ownership: All photographs, digital assets, and website content created by Growing Up Media remain the exclusive intellectual property of Growing Up Media, protected under applicable state and federal copyright laws.

  • Personal License: Upon purchasing digital files or physical prints, parents/guardians are granted a personal, non-exclusive, non-transferable license to view, print, share, and download those images for private, non-commercial use.

  • Model Release & Marketing: Growing Up Media never uses images of minors for commercial, marketing, or promotional purposes without express, written opt-in consent from a parent or legal guardian.

5. Digital Downloads & Refund Policy

  • Custom Print & Digital Goods: Because photo prints and high-resolution digital files are custom-manufactured to order, all sales are final once processed.

  • Damaged or Defective Orders: If physical print items arrive damaged, misprinted, or defective, contact us at info{@}growingupmedia.com within 7 days of receipt for a replacement or resolution.

6. Website Usage & Prohibited Conduct

When interacting with www.growingupmedia.com or our gallery portals, users agree not to:

  • Attempt unauthorized access to restricted student galleries or administrative systems.

  • Screen-capture, reproduce, download, or distribute unpurchased watermarked proof images without authorization.

  • Use the website for any unlawful purpose or in violation of local, state, or federal laws.

7. Limitation of Liability, Risk Allocation, & Indemnification

A. Operational & On-Site Limitation

Growing Up Media maintains $2,000,000 in General Liability Insurance coverage and enforces strict safety protocols, including background-checked personnel. However, to the fullest extent permitted by applicable law, Growing Up Media, its owner, independent contractors, and representatives shall not be held liable for any indirect, incidental, special, consequential, or punitive damages—including lost profits, operational disruptions, or loss of data—arising out of or in connection with our on-site photography services, website operations, or product fulfillment.

B. Force Majeure & Event Disruption

Growing Up Media is not liable for failures, delays, or cancellations of Picture Day sessions resulting from events beyond our reasonable control. These include, but are not limited to: acts of God, extreme weather events, facility closures, power outages, equipment failure, sudden illness, mandatory quarantine, or emergency safety orders issued by school administration or government authorities. In such cases, Growing Up Media’s sole obligation will be to make reasonable efforts to reschedule the Picture Day session.

C. Third-Party Platforms, Print Labs, & Shipping

  • Third-Party Platforms: Our online proofing galleries and order workflows utilize third-party hosting partners (such as GotPhoto Inc. and PCI-compliant payment gateways). Growing Up Media is not liable for temporary web outages, server downtime, security breaches, or data transmission issues occurring on third-party platforms beyond our reasonable operational control.

  • Fulfillment & Shipping: Physical print products are produced by professional third-party print laboratories and delivered via independent shipping carriers (e.g., USPS, UPS, FedEx). Growing Up Media is not responsible for transit delays, misdeliveries, or damaged packages caused by third-party mail carriers, though we will assist clients in securing replacement orders for damaged goods reported within 14 days of delivery.

D. Digital Archiving & Data Retention

While Growing Up Media implements industry-standard digital backup procedures for all captured images, we do not guarantee permanent or indefinite cloud archiving of image files. Parents and guardians are strongly advised to download and secure backup copies of any purchased digital media immediately upon receipt.

E. Maximum Monetary Liability

To the maximum extent permitted under New Jersey law, the total cumulative liability of Growing Up Media for any and all claims arising under or related to these Terms, Picture Day execution, or ordered products—regardless of the legal theory or cause of action—shall not exceed the total dollar amount paid by the school or individual customer for the specific order or service giving rise to the claim.

F. Indemnification

By accessing our services, school administration, clients, and website users agree to defend, indemnify, and hold harmless Growing Up Media and its personnel from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising from: (i) a breach of these Terms; (ii) improper or unauthorized access to password-protected student galleries; or (iii) failure of school staff to maintain the required escort protocols while personnel are on school premises.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.
